{"id":26,"date":"2017-01-31T13:22:56","date_gmt":"2017-01-31T18:22:56","guid":{"rendered":"https:\/\/www.ramapo.edu\/titleix\/?page_id=26"},"modified":"2026-02-27T11:24:33","modified_gmt":"2026-02-27T16:24:33","slug":"rights","status":"publish","type":"page","link":"https:\/\/www.ramapo.edu\/titleix\/rights\/","title":{"rendered":"Know Your Rights"},"content":{"rendered":"<h3>Know Your Rights: The New Jersey\u00a0Campus Sexual Assault Victim&#8217;s Bill of Rights<\/h3>\n<p>Pursuant to NJSA 18A, Chapter 61E<\/p>\n<p>A college or university in\u00a0a free society must be devoted\u00a0to the pursuit of truth\u00a0and\u00a0knowledge through reason\u00a0and\u00a0open\u00a0communication among its members. Academic communities acknowledge the necessity of being\u00a0intellectually stimulating where the\u00a0diversity of ideas is valued. Its rules must be conceived\u00a0for the purpose of furthering and\u00a0protecting the rights of all members of the\u00a0college community in achieving these ends. The boundaries of personal freedom are limited\u00a0to applicable state and federal laws and \u00a0institutional rules and regulations governing interpersonal behavior. In\u00a0creating a community free from violence, sexual assault and\u00a0non\u00adconsensual sexual contact, respect for the individual and human\u00a0dignity are of paramount importance. The state of New Jersey\u00a0recognizes that the impact of violence on its victims and\u00a0the surrounding\u00a0community can\u00a0be severe and long\u00a0lasting. Thus, it has\u00a0established\u00a0this Bill of Rights to articulate requirements for policies, procedures and services designed to insure that the needs of \u00a0victims are met and\u00a0that the colleges and universities in\u00a0New Jersey create and maintain communities that support human\u00a0dignity.<\/p>\n<h4><strong>Bill of Rights\u00a0<\/strong><\/h4>\n<p>The following\u00a0Rights shall be accorded\u00a0to victims of sexual assault that occur:<\/p>\n<ul>\n<li>on the campus of any public or independent institution of higher education\u00a0in\u00a0the state of New Jersey, and<\/li>\n<li>where the victim or\u00a0alleged\u00a0perpetrator\u00a0is a student at that institution, and\/or<\/li>\n<li>when the victim is a student involved\u00a0in an\u00a0off\u00ad campus sexual assault.<\/li>\n<\/ul>\n<h4><strong>Human Dignity Rights<\/strong><\/h4>\n<ul>\n<li>To be free from any suggestion that victims must report the crimes to be assured\u00a0of any other right guaranteed\u00a0under\u00a0this\u00a0policy.<\/li>\n<li>To have any allegations of sexual assault treated\u00a0seriously\u037e the right to be treated with dignity.<\/li>\n<li>To be free from any suggestion that victims are responsible for the commission\u00a0of crimes against them.<\/li>\n<li>To be free from any pressure from campus personnel to:\n<ul>\n<li>report crimes if the victim does not wish\u00a0to do so<\/li>\n<li>report crimes as lesser offenses than\u00a0the victim perceives the crime to be<\/li>\n<li>refrain\u00a0from reporting crimes<\/li>\n<li>refrain\u00a0from reporting crimes to avoid\u00a0unwanted\u00a0personal publicity.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><strong>Rights to Resources On and Off Campus\u00a0<\/strong><\/h4>\n<ul>\n<li>To be notified\u00a0of existing\u00a0campus and community based\u00a0medical, counseling, mental health\u00a0and\u00a0student services for\u00a0victims of sexual assault whether\u00a0or not the crime is formally reported\u00a0to campus or\u00a0civil authorities.<\/li>\n<li>To have access to campus counseling under\u00a0the same terms and conditions as apply to other\u00a0students in\u00a0their institution\u00a0seeking\u00a0such\u00a0counseling.<\/li>\n<li>To be informed\u00a0of and assisted in\u00a0exercising:\n<ul>\n<li>any rights to confidential or\u00a0anonymous testing for sexually transmitted diseases, human\u00a0immunodeficiency \u00a0virus, and\/or\u00a0pregnancy<\/li>\n<li>any rights that may be provided\u00a0by law to compel and disclose the results of testing of sexual assault suspects\u00a0for communicable diseases.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><strong>Campus Judicial Rights<\/strong><\/h4>\n<ul>\n<li>To be afforded\u00a0the same access to legal assistance as the accused.<\/li>\n<li>To be afforded\u00a0the same opportunity to have others present during any campus disciplinary proceeding that is allowed\u00a0the<br \/>\naccused.<\/li>\n<li>To be notified\u00a0of the outcome of the sexual assault disciplinary proceeding\u00a0against the accused.<\/li>\n<\/ul>\n<h4><strong>Legal Rights\u00a0<\/strong><\/h4>\n<ul>\n<li>To have any allegation\u00a0of sexual assault investigated and adjudicated\u00a0by the appropriate criminal and\u00a0civil authorities of the\u00a0jurisdiction\u00a0in\u00a0which\u00a0the sexual assault is reported.<\/li>\n<li>To receive full and prompt cooperation\u00a0and\u00a0assistance of campus personnel in\u00a0notifying\u00a0the proper authorities.<\/li>\n<li>To receive full, prompt, and\u00a0victim\u00ad sensitive cooperation\u00a0of campus personnel with regard to obtaining, securing, and\u00a0maintaining evidence, including a medical examination when\u00a0it is necessary to preserve evidence of the assault.<\/li>\n<li>To be free from any suggestion that victims were contributory negligent or assumed\u00a0the risk\u00a0of being\u00a0assaulted.<\/li>\n<\/ul>\n<h4><strong>Campus Intervention Rights\u00a0<\/strong><\/h4>\n<ul>\n<li>To require campus personnel to take reasonable and\u00a0necessary actions to prevent further unwanted\u00a0contact of victims by their\u00a0alleged\u00a0assailants.<\/li>\n<li>To be notified\u00a0of the options for and\u00a0provided\u00a0assistance in\u00a0changing\u00a0academic and\u00a0living\u00a0situations if such\u00a0changes are\u00a0reasonably available.<\/li>\n<\/ul>\n<h4><strong>Statutory Mandates<\/strong><\/h4>\n<p><strong>\u00a0<\/strong><br \/>\nEach campus must guarantee that this Bill of Rights is implemented. It is the obligation of the individual campus governing board to examine resources dedicated to services required to implement the Bill of Rights and to make appropriate requests to increase or reallocate resources where necessary to ensure implementation. Each campus shall make every reasonable effort to ensure that every student at that institution receives a copy of this document.
