Library Policy on Confidentiality of Patron Records<\/h3>\r\n

The library supports the confidentiality of its patron records. Our policy is consistent with the guidelines set forth by the American Library Association (ALA) and New Jersey Library Association (NJLA) and conforms to the New Jersey Confidentiality of Library Records Law NJSA 18A:73-43.2. <\/p>\r\n

NEW JERSEY STATUTES: TITLE 18A. EDUCATION<\/strong><\/p>\r\n

18A:73-43.1. \"Library,\" \"library record\" defined <\/strong>\r\n \u00a0\u00a0\u00a0 For the purposes of this act:<\/p>\r\n

    \r\n
  1. \"Library\" means a library maintained by any State or local governmental agency, school, college, or industrial, commercial or other special group, association or agency, whether public or private.<\/li>\r\n
  2. \"Library record\" means any document or record, however maintained, the primary purpose of which is to provide for control of the circulation or other public use of library materials.<\/li>\r\n<\/ol>\r\n

      18A:73-43.2. Confidentiality; exceptions <\/strong>\r\n \u00a0\u00a0\u00a0 Library records which contain the names or other personally identifying details regarding the users of libraries are confidential and shall not be disclosed except in the following circumstances:<\/p>\r\n

        \r\n
      1. The records are necessary for the proper operation of the library;<\/li>\r\n
      2. Disclosure is requested by the user; or<\/li>\r\n
      3. Disclosure is required pursuant to a subpoena issued by a court or court order.<\/li>\r\n<\/ol>\r\n
